GlobalNetUS.com is a provider of Internet web site hosting, design and other Internet-related services. In doing such, we provide our customers with the means to obtain vast amounts of public and private information. We respect the right of our customers to obtain information freely over the internet, but should legal or moral questions arise, we reserve the right to take preventative and/or corrective actions. The purpose of this policy is to establish criteria for what we consider to be acceptable content and practices for customers while utilizing our services. This policy will also establish a customers obligation and rights while utilizing the services of GlobalNetUS.com. This policy will be modified from time to time as the need arises. The changes are posted to the website (www.globalnetus.com) and a customers use of our services indicate agreement and acceptance of all terms, including the new or additional terms that may be posted.

Content Ownership and Responsibility

GlobalNetUS.com does not claim ownership of any content posted on customer websites. The ownership of all content placed on a customer web site belongs with the customer. GlobalNetUS.com also does not censor, review, edit or take responsibility for material posted on customer websites or for information a customer discovers or views while utilizing our services. If information is found by our customer to be offensive or explicit in their view, it is the customers responsibility to remove the information. GlobalNetUS.com does not take responsibility or accept responsibility for information provided to a customer via the Internet or services provided, that is inaccurate, unsuitable, offensive or illegal in nature.When a customer places information on their web site, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. GlobalNetUS.com does not attempt to monitor, censor, review, edit or take responsibility for the actions of our customers nor for the content our customers place on their web sites or transmit via email or other services provided by GlobalNetUS.com.

Payment Policy

Credit Card Customers
GlobalNetUS.com will bill credit cards on a monthly basis only. Credit card payments are billed automatically three business days before the anniversary date of the website. If a credit card payment does not clear the bank, the customer will be notified by email to the email address of the owner that is on record with GlobalNetUS.com. Credit card accounts that are more than 10 days past due, are subject to account suspension until all past due funds are received. All payments are made in US (United States) currency.
All credit card billings will appear as GlobalNetUS.com on your credit card statement.
Non Credit Card CustomersGlobalNetUS.com will bill by invoice on a semi-annual and annual basis only. Sorry no monthly billing is available under this option.
Invoices are sent to the owner as listed in our records. All payments are made in US (United States) currency and are billed three business days before the close of the current month for the next month of services.
Accounts that are past due for more than 10 days will be suspended. Customers that pay by check are subject to a $25 Non-Sufficient Fund fee.

Cancellation of Services

GlobalNetUS.com reserves the right to cancel services at anytime. No fees paid in advance of cancellation will be pro-rated. If the cancellation of service is due to a violation of the Terms and Conditions of GlobalNetUS.com, then no refund is due to the customer.
Customer cancellation of services must be made by fax to 920-693-2980 or by email to administrator@globalnetus.com. Email cancellations will not take place until we have notified the account holder and their technical contacts. We require at least one technical contact person to reply to the email as well as the owner to ensure its authenticity. Cancellation requests must include website domain name, user name and password clearly indicated. All cancellation requests must also include the final date of service (date of cancellation). A refund (if a cancellation date is specified), will be issued within 10 business days. If no cancellation date is specified, services will be cancelled on the next billing date and no refund will be due. In order to avoid being billed for another month of service, all cancellations should be made 5 business days prior to the end of the month.

Network and Server Use

Spamming is the sending of unsolicited bulk and/or commercial email messages. Spamming is strictly prohibited and will result in immediate closure of all accounts the customer has with GlobalNetUS.com. Spamming is harmful because it generates negative customer attitudes towards GlobalNetUS.com and can also overload our network connections causing service disruptions for other customers. GlobalNetUS.com reserves the right to investigate all spam complaints it receives and further reserves the rights to make determinations, including but not limited to whether the email recipients are part of an opt in email list or are truly being spammed.SMPT RelayMaintaining a SMPT open relay will result in immediate cancellation (without refund) of a customers account. An SMPT open relay allows anyone from anywhere in the world to bounce email off of the SMPT server. Since this is a technique used often by spammers, and since it has the potential to disrupt services for other customers, it is strictly prohibited.Forging Email HeadersForging or modifying email headers, whether in whole or in part, to mask the originator of an email message is strictly prohibited and will result in the immediate termination of a customer account (without refund).Adult ContentGlobalNetUS.com strictly prohibits utilizing our services for pornography, eroticism or otherwise lewd or obscene (generally classified as adult) content and doing so will result in the immediate cancellation (without refund) of a customer account. GlobalNetUS.com is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography being made available through our services. Obscene or Harmful Speech or MaterialsUsing GlobalNetUS.com services as a means to transmit or post defamatory, harassing, abusive or threatening language or gestures is strictly prohibited and will result in immediate cancellation (without refund) of a customer account.Intellectual Property ViolationsWe (GlobalNetUS.com) define Intellectual Property as the following: copyrights, trademarks, service marks, trade secrets, software, patents and personal privacy rights. We prohibit the violation of these properties and when notified of a violation we will email the customer. It is the customers obligation to repair the violation immediately. If the customer fails to take action, GlobalNetUS.com reserves the right to cancel the customer account (without refund). GlobalNetUS.com also reserves the right to cancel (without refund) the account of any customer that has multiple (more than one) violation of the aforementioned properties.Illegal or Unauthorized Access to Other Computers or Networks Utilizing the services of GlobalNetUS.com to gain access to or gather information about other computers to which you are not entitled is strictly prohibited and will result in the immediate cancellation of a customer account (without refund) and will also result in GlobalNetUS.com notifying law enforcement.We define illegal or unauthorized access to other computers or networks to mean the following: hacking, phreaking, pirating software, maintenance of a warez website or ftp site, posting software registration codes, anarchy, how to information (for phreaking, anarchy, cracking, hacking), posting software cracks, port scans, stealth scans, or other information gathering activities, distribution of viruses, worms, Trojan horses, or other destructive activities including pinging, flooding, mailbombing, denial or service attacks or any activity that may interfere with the ability of others to use the network or any other connected network, system, service or equipment..Credit Card FraudSetting up credit card services on a customer site that results in fraudulent activities will result in the immediate cancellation of q customers account (without refund) and also in the immediate notification of law enforcement.Export ControlIt is not legal to export encryption software over the Internet to points outside the United States. Therefore this activity is prohibited and will result in the immediate cancellation of a customers account (without refund).Other Activities ProhibitedWe prohibit making available or advertising the following activities: ponzi schemes, pyramid schemes, multi-level marketing schemes. Violators will be notified by email and given a reasonable opportunity (no more than 3 days) to make appropriate changes. Failing to make necessary changes will result in the customer account being terminated without refund. Any customer that initiates multiple occurrences (more than 1) of this specific term, will be subject to immediate cancellation of services (without refund). GlobalNetUS.com reserves the right to determine other activities (not listed herein) as unacceptable.

Reselling of Services
|

Customers are prohibited, unless specifically authorized by GlobalNetUS.com, in writing to resell services. We reserve the right to institute legal action against anyone that is found to resell our services without permission. Reselling of services definition also includes sub hosting websites under your primary domain name.

Over-Usage Policy
|
| |
GlobalNetUS.com has established usage limits based on the hosting package selected. Exceeding those limits will result in additional billing each month. Whenever possible, GlobalNetUS.com will notify a customer of over usage prior to billing. Our normal overuse billing is as follows:
Bandwidth Exceeded - $6 per GB over allowed limit
Disk Space Exceeded - $5 per mb over the allowed limit
Email Limits Exceeded - $5 per POP3 account over the allowed limit.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold GlobalNetUS.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against GlobalNetUS.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless GlobalNetUS.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with GlobalNetUS.com's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from GlobalNetUScom's server.

GlobalNetUS.com disclaims any warranty or merchant ability or fitness for a particular purpose. This includes loss of data resulting from delays, non deliveries, wrong delivery and any and all service interruptions caused by GlobalNetUS.com and its employees.
GlobalNetUS.com reserves the right to make changes, modifications, deletions or additions to this policy at anytime. Use of services provided by GlobalNetUS.com constitute customer agreement with these terms and conditions.
